1. Introduction

Welcome to TheLuxeBabe Tax & Consulting (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, virtual tax preparation, and consulting services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

You must be at least 18 years of age to use our Services.

2. Scope of Services 

TheLuxeBabe Tax & Consulting provides virtual tax preparation, filing, and tax consulting services, including IRS notice assistance and client communications. All consultations, document submissions, and filings are conducted electronically through secure, encrypted channels.

Our Services are currently offered to residents of California and Nevada and are subject to all applicable state and federal tax regulations.

3. Service Agreements 

All clients engaging TheLuxeBabe Tax & Consulting for tax preparation or filing are required to review and acknowledge a separate Service Agreement outlining engagement terms, estimated fees, and obligations prior to the commencement of work.

4. Fees and Payment 

• Tax Preparation Fees: Fees are automatically deducted from the client’s tax refund upon successful IRS submission, unless otherwise stated.
   
• Alternative Payments: If a return must be mailed, payment is required upfront via PayPal only.
   
• Non-Refundable Fees: All fees are non-refundable once the tax return has been completed and approved by the client for submission or once the return has been processed.
   
• Pricing Policy: Fees are subject to change with prior notice and may vary depending on the complexity of each tax return and required forms.
   
• No Third-Party Payments: We do not accept Zelle, Cash App, Venmo, or credit/debit card payments except as expressly permitted.

5. Cancellations and Rescheduling

Clients may cancel or reschedule an appointment through the booking link provided in the appointment confirmation email. Cancellations or rescheduling should be made at least 24 hours prior to the scheduled appointment time.

6. Client Responsibility 

Clients are responsible for providing complete, accurate, and truthful information for all tax documents.
TheLuxeBabe Tax & Consulting will prepare your tax return based solely on the information you provide.
We are not responsible for errors, omissions, penalties, or tax outcomes resulting from incomplete or inaccurate information supplied by the client.

7. Confidentiality and Data Security 

We take the confidentiality and security of client information seriously. All client data and documents are collected only through secure, encrypted portals or forms and are not stored directly on our website.

Both financial and personal information shared with TheLuxeBabe Tax & Consulting are treated as confidential. We will not disclose, sell, or share client data except as required by law or to fulfill professional obligations under the terms of service.

8. Intellectual Property 

All content, logos, website materials, forms, and documentation provided by TheLuxeBabe Tax & Consulting are protected by applicable copyright, trademark, and intellectual property laws.

No part of our website, documents, or materials may be reproduced, copied, distributed, or used for any purpose without prior written consent. Unauthorized use may result in legal action.

9. Third Party Links Disclaimer 

Our website and communications may contain links to third-party websites, including but not limited to Google Workspace and social media pages.
We are not responsible for the content, security, or privacy practices of such external sites. Accessing third-party links is done at your own discretion and risk.

10. Limitation of Liability 

TheLuxeBabe Tax & Consulting will prepare your tax return based on the information provided by you.
While we exercise due diligence and professionalism, the accuracy and completeness of all data provided remain your responsibility.

To the fullest extent permitted by law, TheLuxeBabe Tax & Consulting shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services.

11. Dispute Resolution and Arbitration 

Any disputes arising from or related to these Terms or the Services provided shall be resolved exclusively through binding arbitration in the State of Nevada, in accordance with the rules of the American Arbitration Association.

By using our Services, you waive your right to file a lawsuit in court, except for matters that may be brought before small claims court.

12. Compliance with state Privacy Laws

California Consumer Privacy Act (CCPA)

If you are a resident of California, you have rights under the California Consumer Privacy Act (CCPA), including the right to request disclosure of data collected, request deletion, and opt out of data sharing.
We comply with the CCPA by maintaining transparency regarding the collection and use of your personal data.

Nevada Privacy Law (NRS603A)

Pursuant to Nevada law, consumers may submit a verified request to opt out of the sale of personal data.
Although TheLuxeBabe Tax & Consulting does not sell personal information, we honor all lawful opt-out requests as required under Nevada state law.

13. Refusal or Termination of Service 

We reserve the right to refuse service, terminate accounts, or restrict access to our Services for misuse, nonpayment, fraudulent activity, or violations of these Terms.
Clients may also request termination of their account or opt out of services at any time.

14. Modifications and Updates to Policy

TheLuxeBabe Tax & Consulting reserves the right to modify, amend, or update these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of our Services after any changes constitutes acceptance of the updated Terms.

15. Privacy Policy 

Our separate Privacy Policy governs how we collect, use, and protect personal data. All terms of the Privacy Policy apply to your use of our Services.

16. Governing Law

These Terms and any related disputes shall be governed by and construed under the laws of the State of Nevada, without regard to its conflict of law principles.
